General: This Puppy/Dog is in good health at the time of this sale. Puppy is current on all vaccinations and wormings. Purchaser is completely satisfied with the appearance of this Puppy/Dog and waives any and all claims regarding the puppy’s conformation and physical appearance. Ayer's Long Coat German Shepherds(referred to as ALCGS and or Breeder) shall not be responsible for liability on any claims for damages arising from/or connected with the agreement or sale of this Puppy/Dog. Ownership and Title to this Puppy/Dog passes on to Purchaser upon taking possession of this Puppy/Dog. If this animal is lost, stolen, or injured, OR causes injury or damage to person or property thereafter, Purchaser is still held responsible. The words 'Puppy' or 'Dog' shall refer to this Puppy being purchased. A. If your Vet gives this Puppy a - first at your vet shot- within 2 weeks after we have just given Puppy his shot- AFTER we have already given him his shot- this health guarantee is VOID. Rabies shot is to be given 2 weeks AFTER ALL other vaccinations. Never give a sick puppy or dog a vaccine. 2. Breeder is NOT responsible for ANY medical or veterinarian costs incurred After the Puppy leaves the Breeder's premises. 3. Purchaser has three (3) days in which to have Puppy examined by a licensed veterinarian. If the veterinarian finds illness acquired at the Breeders or congenital or hereditary disease, Purchaser may receive back purchase price paid for the Puppy, excluding shipping, crate, health certificate, etc.; OR a 'Replacement Puppy'. IN EITHER CASE: Breeder MUST be notified WITHIN the three (3) day time period and allowed to contact the Purchaser's veterinarian AND Puppy MUST be returned within 1 week after the initial '3 day vet visit' in the SAME condition as when Puppy left the Breeders premises. ALL registration papers must have ownership signed back over to the Breeder AND a Letter of Documentation from the 'diagnosing' veterinarian stating the 'diagnosis' must accompany the Puppy on His/Her return to the Breeder. Return costs of the Puppy is the new owners responsibility. This whole health guarantee is VOID if Purchaser does not obtain a veterinary exam within three (3) days after purchasing the Puppy. 4. After the three (3) day guarantee: NO CASH REFUNDS WILL BE MADE UNDER ANY CIRCUMSTANCES. (Unless in the rare case where BREEDER chooses to make an exception) 5. There is a two (2) year Replacement Puppy Guarantee, from the date of purchase, if Congenital or Genetic disease is actually 'Diagnosed' AND if the 'Disease' would 'severely' affect the quality of life of the Puppy (Severely crippling or 'life threatening and requires lifetime constant prescription medication) or if the 'disease' results in death or euthanasia of the Puppy/Dog - AND IF ALL contract conditions have been met. With a congenital or hereditary disease diagnosis: A second opinion is required by a licensed veterinarian who is a 'specialist' in the area of the diagnosis. With Hips/Elbows- 2nd opinion includes sending x-rays to the OFA(Orthopedic Foundation for Animals). 6. Concerning Canine Hip Dysplasia(referred to as CHD)/Elbow Dysplasia(ED)- Diagnosis: For Pet/Limited registration puppies- Guarantee covers a diagnosis of 'severe' Hip/Elbow Dysplasia in which the disease is constant and crippling. In the event of a Hip Dysplasia diagnosis: If x-rays are taken under 2 years of age, the Puppy MUST be again x-rayed at over 2 years of age for the hip guarantee portion of this contract to be in effect. Many poor hip readings are inaccurate due to improper positioning by veterinarians and or their staff. (Refer to 'The Importance of Correct Positioning on Canine Hip X-Rays'. (http://www.leerburg.com/articles.htm) For Elbow Dysplasia: guarantee covers a diagnosis of 'severe' Elbow Dysplasia (Grade lll) and we require a diagnosis from a 'specialist' as well. The Elbow x-rays must be taken AFTER 10 months of age. In either case- when x-rays are taken (over 2 years for Hips- over 10 months for Elbows), Breeder requires a diagnosis from a veterinarian who is a specialist-Board Certified in Orthopedics or Radiology AND that those x-rays be sent to the O.F.A. as well. This would equal 2 'qualified' opinions. Breeder must be able to view any x-rays BEFORE any surgeries are preformed. 7. All second (2nd) opinions must be from a Veterinarian from a 'different' practice. 8. CONCERNING HIP/ELBOW GUARANTEE: Puppies must not be over exercised during their growth period (during their first 2 years). Over exercising is as follows: No running/jogging with persons, jumping (Example: agility jumps, off and on to- porch decks, high rear truck beds, trampolines etc.), or 'pulling'- bikes, carts, scooters, etc. NO jumping from elevated areas or over obstacles. If the Puppy has been involved in any of these activities OR if the Purchaser neglects to follow the written guidelines from the Breeder concerning precautionary measures one must follow to avoid hip problems OR due to any injury sustained while in Purchaser's possession, the hips/elbows will NOT be guaranteed and the hip/elbow guarantee section of this contract will be null and VOID. Puppy is to have NO CALCIUM supplementation or the hip/elbow guarantee section of this contract will be null and VOID. 9. FOR REPLACEMENT PUPPY: In the case of CHD or other Congenital or Genetic Conditions: Breeder will need Letters of Documentation from the 'diagnosing' veterinarians' stating the 'diagnosis'. Breeder may require x-rays(in conditions where they needed to be taken) and/or all documentations of the 'diagnosis' to be sent to Breeder and/or Breeder's veterinarian. Breeder and/or Breeder's veterinarian must be allowed to contact Purchaser's veterinarians' and be allowed to view ALL records/x-rays/tests etc. Breeder has the right to have the x-rays re-done by her vet if deemed necessary. PENDING VERIFICATION AND AGREEMENT with the 'Diagnosis', by the Breeder's Veterinarian, Purchaser can receive a Replacement Puppy of the same sex and of equal value, from the next available litter. A. For a Replacement Puppy: Purchaser DOES NOT HAVE TO RETURN their originally purchased Puppy to receive a Replacement Puppy when ALL of the contract conditions have been met -EX: '2nd opinions, no jumping, feeding quality food, etc.' B. IF ALL contract conditions have NOT been met we, the Breeder,would require the originally purchased Puppy to be returned to the Breeder with all papers signed back to the Breeder -in order for Purchaser to receive a Replacement Puppy so we, the Breeder,- may get the second opinion. We need to be positive about the diagnosis before replacing a Puppy and for making decisions in our Breeding Program. C. For Replacement Puppy: When Purchaser would like to return the Puppy or when originally Purchased Puppy needs to be returned to the Breeder: Puppy/Dog must be returned to the Breeder, within 2 weeks of the 'Diagnosis.' In the case where the Purchaser had the 2nd opinion, a Replacement Puppy will be given after Breeder's Veterinarian examines all records and is in agreement with Purchaser's veterinarians' diagnosis of a genetic disease that would 'severely' affect the quality of life of the Puppy or is 'life threatening'. Or if Pup is being returned and Breeder is doing the 2nd opinion-A Replacement Puppy will be given AFTER the 'Breeder receives the 2nd opinion' that states Puppy has a serious genetic disease. Breeder's Veterinarian's decision will be the final decision. D. In the event of any discord or disagreement pertaining to health issues Breeder reserves the right to have their own veterinarian or a veterinarian of Breeder's choice examine said Puppy/Dog(at no cost to the Breeder)- and/or all pertaining records. In all cases Breeder's Veterinarian's decision shall determine final outcome and will be the final decision. E. AFTER ALL requirements have been satisfied the Purchaser will be put on a list for a Puppy from the next 'available' litter. F. Purchaser must elect to receive the Replacement Puppy within 1 year of the diagnosis. G. IN ALL CASES WHERE a Puppy is being RETURNED OR REPLACED: All transportation costs of returning Puppy -AND receiving Replacement Puppy are Purchaser's responsibility. IN ALL CASES WHERE a Puppy is being Replaced or if Breeder has chosen to return any part of the actual purchase price paid, Breeder will require: Proof of spay/neuter by Purchaser's veterinarian AND ALL registration papers must be returned to the Breeder. If Puppy is being Returned- Breeder will require ALL registration papers to be returned to the Breeder having had ownership of the Puppy signed back over to the Breeder and all registration papers must accompany the Puppy on return to the Breeder. G. If a Purchaser desires to keep the originally Purchased Puppy and does not wish to have a Replacement Puppy: In rare cases, at the 'discretion of the Breeder' and the 'option of the Breeder'-The Breeder 'MAY' upon proof of spay/neuter and return of ALL registration papers, reimburse the Purchaser an amount 'determined by the Breeder' in line with the condition and it's effects on the dog's life. In any case, this amount shall not exceed, in total and in combination for all conditions, a lifetime maximum of one half the purchase price of the originally purchased Puppy. When surgery is required Breeder will pay the - 'up to' 1/2 dollars back- either to the Veterinarian performing the surgery or to the Puppy Owners AFTER the surgery has been performed. 10. The Breeder reserves the right to not place a 2nd/replacement Puppy in the Purchaser home. Should the 'Breeder decide' NOT to place a 2nd Puppy- the Replacement Puppy- in Purchasers home and Purchaser would like to keep the originally Purchased Puppy, Breeder shall refund 1/2 of the actual purchase price paid for the Puppy(excluding shipping, crate, flight, etc.).The return of the '1/2 purchase price paid' would be provided only after Veterinarian verification of spay/neuter is provided to the Breeder and ALL registration papers have been returned to the Breeder. Should the 'Breeder decide' NOT to place a 2nd Puppy- the Replacement Puppy- in Purchasers home and originally purchased Puppy is being returned to the Breeder, Puppy would need to be returned to the Breeder accompanied by ALL registration papers having had ownership signed back over to the Breeder and Breeder would return full purchase price paid(excluding shipping, crate, health certificate, etc.) 11. When the Breeder has opted to return any monetary amounts, the Breeder shall have up to two years to do so. 12. 'Replacement Puppy' is limited to one replacement Puppy. 13. Breeder assumes NO liabilities for consequences for when ever anesthesia is used.(Pre-blood work is usually recommended) 14. EARS: Due to environmental circumstances beyond Breeder's control, there is no guarantee for ears to stand. If the Puppy's ears are not fully standing by the age of four months it is the 'Purchaser's Responsibility' to have the puppy's ears glued/taped by a licensed veterinarian OR by the Breeder Or by Purchaser per Breeder's instructions... If you have another Puppy/Dog at home, playing should be supervised till your Puppy's ears go up. They WILL bite each others ears when playing and that could possibly damage the cartilage of Purchasers Puppy's ears - possibly causing them not to stand. If Purchasers Puppys ears are not standing by the time Puppy is 4 months old, it is the Purchasers responsibilty to contact the Breeder for instructions on how to get Puppys ears up. 15. TEMPERAMENT: Due to environmental circumstances beyond Breeder's control, there is no guarantee for temperament. The environment in which the Puppy is raised and how the Puppy is raised/socialized by the Purchaser is a major(at LEAST 65%) factor in temperament development. 16. For White Puppy's: There is NO guarantee for the Puppy's coat to stay pure white, nor to keep the dark nose, as some pups develop some cream in the coat or the nose may lighten as they mature. 17. In the regrettable event of the death of the Puppy/Dog, while still under the guarantee terms of this contract, an autopsy MUST be performed to determine the cause of death. Documentation of the outcome is required from the Purchaser's veterinarian. Breeder and/or Breeders veterinarian will need to speak to the Purchasers veterinarian and be allowed to see records/x-rays/test results etc. 18. Purchaser agrees not to euthanize this Puppy, except under emergency conditions to end suffering and with the recommendation of the veterinarian, without the permission of the Breeder while under the terms of this contract. 19. Purchaser agrees to enroll Puppy in a 'Puppy Class' for socialization with strangers and for meeting puppies/dogs that are 'strangers' to them. Your friends and neighbors, and friends and neighbors dogs, are not enough-they are his/her 'buddies'. The main socialization needs to be done by the time Puppy is 4 MONTHS OLD. In addition Puppy/Dog is to attend at least 1 additional Basic Obedience class for manners and continuation of socialization. Dog Training Classes: Make sure the trainer is experienced with German Shepherds and uses COLLAR corrections and praise. NOT - treat training, clickers, halti's, harnesses, etc. 20. The Puppy/Dog is not to be tied, chained, or otherwise tethered; nor allowed to roam free, except while on a leash or under the direct supervision and control of the owner. 21. Breeder is not responsible for disapproval of landlords or allergies to pets. 22. This guarantee is provided to the original Purchaser ONLY and is NOT transferable. 23. If unfortunate unforeseen events arise where the Purchaser can not keep the Puppy/Dog, the Breeder has '1st Right of Refusal'. Which means the Breeder is to be offered the Puppy/Dog back first before other arrangements can be made. Breeder is under NO obligation to give back any money for the return of the Puppy/Dog- but may make an offer. We could also help to find a home for the Puppy as we do not want ANY of our Puppies to be brought to a shelter. a. If Purchaser has a home they would like the Puppy to go to, Breeder must receive in writing the new owners name, address and phone number. If the Puppy was to be given away without the Breeder being notified, the original Puppy Purchaser would be held liable for a $500.00 fine for the breach of this part of this contract. Breeder needs to keep track of Puppies for heath and registration purposes. 24. Feeding Puppy: Purchaser agrees to feed Puppy a QUALITY 'MEAT' based dog food. NO corn OR by-products. We are now feeding INNOVA ADULT, green bag, which we highly recommend and we don't recommend any others at this time. If you choose another quality product that has 'Large Breed' as a choice- Purchaser agrees to put Puppy on a 'Large Breed' dog food at 4-6 months old if advised to do so by the Breeder. Purchaser should contact Breeder by 4 months of age to inquire about when and IF their Puppy should start the 'Large Breed'(for their hips/legs)dog food. Too early can cause the pup to be underweight as it has less calories, fat and protein. When Puppy is 6-10 months of age if Puppy is growing too fast, too quickly, Breeder may recommend putting Puppy on Adult Dog Food. NO Hills Science Diet or Eukanuba or Iams. Failure to comply with the feeding portion of this contract will VOID the whole heath and hip/elbow portion of this guarantee. ****** Feed Puppy: 4 times a day till 3 months old; then 3 times a day till 4 months old; then at 4 months old - 2 times a day for the rest of Puppy's life.(will make his life more enjoyable plus is supposed to help lessen the chance of Puppy/Dog getting BLOAT.) FEED puppy ALL that Puppy wants at each feeding- make sure there is a bit left in the bowl -to know Puppy is not hungry and is getting all the needed nutrients. 25. Address Change: Purchaser agrees to inform seller of new address when they move or change phone numbers for the life of the dog. 26. Naming Puppy:The Purchaser has the option of naming their new dog with the exception that Puppy must carry the kennel name "Ayer's" at the front of their registered name. Example: Ayer's Star of Destiny. If Buyer fails to use "Ayers" in front of the registered name, all guarantees made by the Breeder in this contact will become VOID. 27. ***Photos: Purchaser agrees to provide to ALCGS'S with 3 QUALITY pictures of their Puppy shortly after Puppy's 1st year birthday, 2nd year birthday and 3rd year birthday. 1 photo of Puppy/dog needs to be standing from the side view, 1 picture from the front -a sit, and 1 picture a head/face photo. Pictures need to be taken with the camera down on the level of the dog so we can see his/her actual structure/size. Of course we LOVE to see our Puppies any other times and any other photos will be greatly appreciated!!! This is the Puppy/Dog's growth period and we like to see how they are maturing. We care about our dogs and would like to track their progeny and see how they look at various stages of growth to help further our breeding program. 28. Breeder strongly urges Purchaser to keep in touch with Breeder regarding the growth and development of their Puppy. While most veterinarians are useful in many areas of a dogs life, the Breeders are the ones who have been there when it comes to the development of this specific breed. The German Shepherd Dog is unique, and as such, has a unique growth patterns and health issues that many veterinarians are not familiar with observing. **** Please contact us if your puppy is ever not well before you go to your vet - IF it is not an emergency- and we may be able to save you some worry, time, and money. Please contact us if you question what you are being told by your vet. We can call our Vet and get another opinion. The Purchaser ALSO agrees to contact the Breeder at all times when the dog has been seen by a veterinarian for any condition other than routine reasons for the life of their Puppy/Dog so we can be advised for our breeding program. 29. In the rare instance where we ship a Puppy with out the contract having been returned yet: If Breeder does not receive the contract back within 2 weeks after Purchaser has received their Puppy, this whole contract will be VOID and there will be NO Health GUARANTEE. 30. Not for Breeding: This portion of the contract in in effect for the lifetime of the dog. This Puppy/Dog is being sold and purchased as a pet/companion animal and is NOT for breeding purposes and is NOT to be bred. Let it be understood that it is a quality representative of it’s breed and but that it is being sold on a limited registration, which makes it ineligible for breeding purposes and 'conformation' showing. This is to protect the integrity of the breeder’s bloodline, the health of the pet and to help control the pet population. It is suggested that you have your Puppy/Dog spayed/neutered by one year of age to avoid any reproductive illnesses, conditions, or unwanted pregnancies. a.This Puppy is not being sold for the purpose of being bred, therefore none of it’s progeny is ever eligible for registration with ANY registries. b. By signing this guarantee contract Purchaser is agreeing to NEVER breed this Puppy/Dog (intentionally or unintentionally)- under ANY dog registries for pet or profit AND to have this Puppy SPAYED/NEUTERED. Fine for breeding under any other registry is $2,000.00 plus $1,500.00 per puppy sold plus return of this Puppy purchased to the breeder as well as any other pups kept by the purchaser. c. In the event this Pet Puppy/Dog is bred, sired or conceived a litter during the terms of this Guarantee, the entire health and joints portion of this Guarantee will be null and VOID. 31. Breeder holds the AKC papers until Breeder has received verification from Purchasers vet that this Puppy has been spayed/neutered. AKC Registration Papers will be sent to the Purchaser ONLY - as soon as Breeder receives verification of the spay/neuter from the Purchasers veterinarian. Papers will not be sent if the Puppy has been transferred to any other person with out the Breeders written authorization. *** After one year from the date of Breeder registering the litter, the price the AKC charges to register the Puppy with the AKC will go up - so you will want to take care of the paper work prior to Puppy's 1st birthday. 32. Purchaser has read the multiple SOCIALIZATION articles and PARVO article on the 'Important Info and Health and Training Links' page of ALCGS website. 32.
